PRIVACY POLICY

The data controller for the e-shop www.kourtis-junior.gr is the Société Anonyme “IOANNIS AR KOURTIS SA,” with general commercial register number 153203201000 and VAT number 801271856. Its registered office is at Malakonta 6, Kifisia, Attica, Greece, PC: 14564. The company’s email is junior@kourtis.gr, and it also acts as the Seller.

The rules for processing personal data (the “Rules”) govern the basic principles of collecting, processing, and storing personal data. The data controller follows these principles when processing the personal data of the Customer (visitor/registered user/buyer).

The e-shop’s operation is also governed by the applicable Code of Conduct. Customer data is collected for specific and lawful purposes and is processed fairly and accurately. Personal data is processed using secure means to prevent its unlawful destruction, disclosure, or other illegal activities.

The Customer agrees that the personal data they voluntarily submit at the time of an order (whether they register or not on the website) will be processed for the purposes of selling products and services on the e-shop www.kourtis-junior.gr and in accordance with these Rules.

When ordering products, the Customer must provide their personal details in the relevant fields provided by the Seller. These details are necessary for the correct execution of the order and include: name, surname, delivery address, phone number, and email address.

By agreeing to the processing of their personal data for the purpose of selling products and services in the Seller’s e-shop, the Customer also agrees to the use of the email address and phone number they provide for sending essential informational messages required to complete the order.

The data controller acknowledges and respects the right to privacy of every Customer who orders from the e-shop www.kourtis-junior.gr. The data controller collects and uses the Customer’s personal data (name or surname, address, phone number, email address, and other information provided during the order) for processing orders or fulfilling other contractual obligations. The Customer can express their consent or disapproval regarding the use of their personal data for direct marketing purposes by selecting the checkbox “I agree that my personal data will be used for direct marketing purposes.”Following this, the Seller will send a regular newsletter to the Customer’s email address. Each such email allows the Customer to unsubscribe from the newsletter via a link at the end of the email, should they decide they no longer wish to receive it. The Customer should note that mailing lists are independent. If they unsubscribe from the Seller’s newsletter, they will still receive emails related to their account, such as order status notifications, password reset messages, and others. If a Customer decides they no longer want to use the Seller’s shop and wishes to have their personal data removed from the Seller’s database (or if they want to receive all personal data associated with their account), they can send an email to junior@kourtis.gr.

The Seller confirms that the personal data provided by the Customer will be processed exclusively for the purpose of selling products and services on the e-shop www.kourtis-junior.gr, for analyzing the Seller’s activities, and for direct marketing, unless the Customer has opted out of direct marketing. The Seller undertakes not to disclose the Customer’s personal data to third parties, except for executives, employees, partners (in case the Customer wishes to order partner services offered by the Seller’s e-shop), or agents/helpers of the Seller who provide delivery or other services related to the correct execution of the Customer’s order. In all other cases, the Customer’s personal data can only be disclosed to third parties in accordance with the procedure established by Greek law.

Personal data that has been agreed to be used for direct marketing purposes is stored in an active database and used for three (3) years. After this period, the customer data is automatically destroyed by the controller.

The processing of personal data is carried out in accordance with the provisions of the General Data Protection Regulation (GDPR 2016/679), any specific national and European legislation for certain sectors, the current Greek legislation on personal data protection, as well as the protection of personal data and privacy in the field of electronic communications (Law 3471/2006, as applicable), and the decisions of the Hellenic Data Protection Authority (HDPA).

Τransparency obligation

The Customer has the right to access their personal data, as well as the right to correct or delete incorrect, incomplete, or inaccurate personal data by sending an email to junior@kourtis.gr or by calling +30 210 6122614. In this case, the Seller must immediately comply with the Customer’s request (within 1-2 business days). If the Customer feels their request has not been satisfied, they are informed of their right to appeal to the competent supervisory authority, the Hellenic Data Protection Authority (www.dpa.gr, 1-3 Kifisias St., PC: 11523, Athens).

Changes to the Rules

The data controller has the right to partially or fully replace the Rules by publishing them on the www.kourtis-junior.gr e-shop.

Additions or modifications to the Rules take effect from the date of their publication. If the Customer disagrees with the new version of the Rules, they have the right to refuse them in writing. If the Customer continues to use the services provided by the e-shop after the Rules have been supplemented or modified, the Customer is considered to have accepted the new version of the Rules.

Information Presentation and Communication

All notifications regarding personal data processing are provided to the data controller via email at junior@kourtis.gr or by mail. The response is provided by the data controller in the same format as the message or claim received from the Customer.

  1. Formation of the Sales Contract

To place an order on the www.kourtis-junior.gr e-shop, the following are required:

  • Filling out the special form with the necessary details for the formation of the sales contract.
  • The unconditional acceptance of the terms of the sales contract and the terms of use, particularly the collection and, where required, the use of personal data.

The Customer can order products in the following ways:

  1. By electronic registration on www.kourtis-junior.gr
  2. Without registration on www.kourtis-junior.gr
  3. By phone
  4. By email

The agreement between the Customer and the Seller is considered concluded from the moment the Customer, after selecting the item to be purchased, clicks the “Order” link, and when the Seller contacts the Customer via phone or email to confirm the order. The email confirms the order by sending a message about the order confirmation.

Every purchase agreement between a Customer and a Seller is registered and stored in the electronic database of www.kourtis-junior.gr.

  1. Customer Rights

The Customer has the right to purchase products on the www.kourtis-junior.gr e-shop in accordance with the procedure set out in these Terms and in other sections of the Seller’s e-shop.

The Customer has the right to access their personal data and to request the correction of incorrect, incomplete, or inaccurate personal data by email at junior@kourtis.gr or by calling +210 6122 614. In this case, the Seller must comply with the Customer’s request immediately (within 1-2 business days).

The Customer has the right to withdraw from the purchase and sale contract concluded with the www.kourtis-junior.gr e-shop by notifying the Seller in writing (via email, stating the item to be returned and the order number) no later than fourteen (14) days from the day of delivery. The Customer can exercise the right of withdrawal only if the item has not been damaged, its appearance has not been altered, it has not been moved to a location other than the place of delivery, it has not been used, and it has been kept in its original packaging. The return costs are borne by the Customer.

  1. Customer Obligations

The Customer is obliged to pay for the products on time, accept them, or return them in accordance with the procedure set out in these Terms. In case of a change to the order, the Customer must immediately inform the Seller.

  1. Seller Rights

The Seller has the right to set the minimum size of the shopping cart, i.e., the minimum amount for a Customer’s order to be processed. The amount is visible when viewing the shopping cart.

If the Customer attempts to undermine the stability and security of the e-shop or violates their obligations, the Seller has the right to immediately and without notice restrict or suspend the use of the e-shop or, in exceptional cases, to cancel the Customer’s registration.

In serious cases, the Seller can suspend or terminate the e-shop without notifying the Customer.

The Seller has the right to cancel the order without prior notice to the Customer if the Customer fails to pay for the products within seven (7) business days of making the payment by bank transfer.

The Seller reserves the right to modify the terms and conditions of delivery or to terminate the order without delay for significant reasons, notifying the Customer and returning the payment if the Customer has already paid for it.

  1. Seller Obligations

The Seller undertakes the obligation to provide the Customer with access to the services offered by the www.kourtis-junior.gr e-shop in accordance with the terms and conditions set out in these Terms and in other parts of the e-shop.

The Seller undertakes the obligation to respect the Customer’s right to privacy regarding their personal information, specifically to process the personal data specified by the Customer.

The Seller undertakes the obligation to deliver the products ordered by the Customer to the address specified by the Customer under the terms set out in Article [10].

If the Seller is unable to deliver the ordered product to the Customer due to significant circumstances, the Seller undertakes the obligation to offer a similar product or one as close as possible in its characteristics. If the Customer refuses to accept a similar product, the Seller undertakes to refund the money paid by the Customer within three (3) business days, provided that prepayment has been made.

If the Customer activates the right of withdrawal under Article [5] and subject to the conditions mentioned therein, the Seller undertakes to retrieve the products and refund the money paid by the Customer within fourteen (14) days of the Customer’s explicit activation of the withdrawal.»
